There has been a little bit of an update on this. 

 

Some people were insisting it caused ranking penalties. Of course, they are likely IM'ers looking for any excuse why their site is not ranking #1 other than the likely reasons of A) their site stinks or they have not done anything to promote their site and think it should just rank because the "content is better than their competitors".

 

John Mueller stated in a hangout yesterday that Google does not penalize the rankings of a site for this. They simply remove the rich snippets.
